§ 8. Client Links
1. The User may give Clients Client Links. A Client uses them without opening an account and is not a party to the Agreement.
2. A Client Link works until the User generates a new link or switches access off, or until the validity period shown in the Service ends. The User gives a Client Link only to the person it concerns and is responsible for the consequences of passing it to other people.
3. The User, as controller, informs the Client about the processing of the Client's personal data.
§ 9. Rules for using the Service
1. The User uses the Service in line with these Terms, the law and good practice.
2. In particular it is forbidden to:
1) provide unlawful content, including content that infringes the rights of others, for example copyright in photos, visualisations or designs;

5) resell access to the Service or give it to third parties other than Studio Members and Clients.
3. The Extension takes product data from an online shop's page only at the User's command. The User is responsible for the lawful use of content saved this way, including product photos.
§ 10. Reporting illegal content
1. The Provider's point of contact for the authorities of the Member States, the European Commission, the European Board for Digital Services and for recipients of the service, within the meaning of Articles 11 and 12 of Regulation (EU) 2022/2065 (the Digital Services Act), is the e-mail address contact@projado.com. Communication is possible in Polish and English.
2. Anyone may report to the Provider content they consider illegal, at the address given in paragraph 1. A report should contain:
1) the reasons why the content is illegal;
2) where the content is located (for example a web address);
3) the first and last name or the name and the e-mail address of the person reporting, except for reports concerning the offences referred to in Article 16(2)(c) of the Digital Services Act;
4) a statement that the person reporting believes in good faith that the information in the report is true and complete.
3. The Provider confirms receipt of the report, deals with it without undue delay and informs the person reporting of the decision.
4. If the Provider removes content, disables access to it or suspends an Account, it gives the User the reasons for that decision together with information about the available means of redress, unless the law does not allow it. The User may appeal against the decision at the address given in paragraph 1.
5. The Provider does not review Content continuously and does not use automated content moderation.
§ 11. Rights to Content and to the Service
1. The User keeps all rights to the Content. The User grants the Provider a non-exclusive, free licence to store the Content, reproduce it in the memory of IT systems, display it to Studio Members and Clients and process it, only to the extent and for the time needed to provide the services, including making copies of data on request and backups.
2. The Service, including its software, layout and marks, is protected by law. The rights to it belong to the Provider or to the parties that licensed it to the Provider. The User may use the Service only within the Agreement.
§ 12. Fees and limits
1. The Service is currently provided free of charge.
2. Up to 5 Active Projects can be run in one Studio at the same time. Finished and archived Projects do not count towards this limit. The Provider may raise the limit for a given Studio on individually agreed terms.
3. Paid plans will be introduced by changing these Terms under § 20. The Provider will inform Users about them by e-mail at least 30 days in advance. A User who does not accept the fees may terminate the Agreement under § 18.
4. After paid plans are introduced:
1) the Provider does not charge for one Active Project of each User for as long as the service is provided within the Service. This rule may be changed only under § 20, with at least 60 days' notice, and never for Projects that are active on the day the change is announced;
2) Projects created before paid plans are introduced stay fully available and free until the User finishes or archives them.
5. An obligation to pay arises only from the User expressly ordering a paid plan. A change to these Terms alone never creates a fee.
6. Whatever the plan, the User can download a copy of the Studio's data under § 7(4).
§ 13. Personal data
1. The rules for processing the personal data of Users, for which the Provider is the controller, are set out in the Privacy Policy.
2. For the personal data of Clients entered into the Service the Provider is a processor, and the rules for processing it are set out in the Processing Agreement.
3. The User is responsible for having a legal basis for processing Clients' personal data, for informing Clients as the law requires, and for entering only data needed to carry out the Project, in particular for not entering special categories of data without a legal basis.
§ 14. Liability
1. The Provider is liable to the User only for damage caused intentionally or through gross negligence. Liability for damage arising from other causes is excluded.
2. The Provider does not guarantee that the Service will be available without interruption or free of errors. The Provider may limit access to the Service for a time in order to maintain it, update it or keep it secure. Interruptions in the Service are not a failure to perform the Agreement and give no right to compensation.
3. The Provider may develop the Service, change its functions or withdraw them, as long as this does not deprive the User of the ability to download a copy of their data.
4. The Provider is not liable for damage resulting from:
1) Content, including its lawfulness and accuracy;
2) loss of data, to the extent the User could have prevented it by downloading the copy of the Studio's data offered in the Service;
3) the User giving sign-in details or Client Links to unauthorised people;
4) force majeure, a failure of a network or infrastructure outside the Provider's control, or the acts of third parties;
5) use of the Service contrary to these Terms or the law.
5. The Provider is not liable for lost profits, indirect damage, or the loss of clients, orders or reputation.
6. The Provider's total liability to the User on all grounds connected with the Agreement, including the Processing Agreement, is limited to the sum of the fees the User paid for the month before the event that caused the damage, but not less than 100 zł.
7. The statutory warranty for defects of the service is excluded.
8. The User reports damage to the Provider without delay, no later than 30 days from the day they learned of it, so that its effects can be limited.
9. The limits in paragraphs 4–7 do not apply to damage caused intentionally or through gross negligence. Nothing in this section limits or excludes liability to the extent that mandatory provisions of law do not allow it.
10. Paragraphs 1 and 4–8 do not apply to a User who is a consumer, or to a natural person concluding an Agreement directly connected with their business where the content of the Agreement shows that it is not of a professional nature for them (Article 385⁵ of the Polish Civil Code).
§ 15. Third-party claims
1. If a third party, in particular a Client, brings a claim against the Provider, or an authority imposes a penalty on the Provider, in connection with Content entered by the User or with the User's breach of these Terms or the law, the User will reimburse the Provider for the amounts paid on that account and for reasonable costs, including legal costs, to the extent the damage or penalty results from the User's act or omission.
2. The Provider informs the User of such a claim without delay. The User may join the defence.
§ 16. Suspension of an Account
1. The Provider may suspend an Account if the User breaches these Terms or the law, or if the security of the Service or of other Users requires it.
2. The Provider informs the User of the suspension and its reason under § 10(4). The suspension lasts until its cause is removed.
3. A gross or persistent breach of these Terms entitles the Provider to terminate the Agreement under § 18(4).
§ 17. Complaints
1. A complaint about the Service can be made through the support chat in the Service or at the e-mail address contact@projado.com.
2. A complaint should contain the Account's e-mail address, a description of the problem and the expected way of resolving it.
3. The Provider deals with a complaint within 14 days of receiving it and sends the answer to the Account's e-mail address or in the support chat.
§ 18. Termination of the Agreement and deletion of the Account
1. The User may terminate the Agreement at any time by deleting the Account in the Account settings.
2. If the User is the only Owner of a Studio that has other Studio Members, the User hands the Owner role to another Studio Member before deleting the Account.
3. Deleting the Account locks it at once, together with the Studios in which the User is the only Studio Member (paragraph 3a). The Account's data is kept for a further 30 days; during that time the User can restore the Account together with those Studios by signing in to the Service. Membership of Studios that have other Studio Members ends when the Account is deleted and is not restored. After that time the deletion of the Account cannot be undone. Data is deleted in the way and within the times described in the Privacy Policy. Before deleting the Account the User can download a copy of their data and of the Studio's data.
3a. When its Owner deletes a Studio, the Studio is locked at once. The Studio's data is kept for a further 30 days; during that time the Owner can download a copy of it, restore the Studio or delete the data immediately. After that time the data is deleted irreversibly.
4. The Provider may terminate the Agreement with 30 days' notice by informing the User by e-mail, and with immediate effect in the case of a gross or persistent breach of these Terms or the law.
5. If the services within the Service are to end, the Provider informs Users by e-mail at least 30 days in advance and makes it possible to download a copy of the data before they end.
§ 18a. Moving data and switching provider
1. The User can at any time, including during a notice period, download all data that can be exported: a copy of the Studio's data (§ 7(4)) and a copy of their own Account data. The Provider prepares the export without undue delay (Article 25 of Regulation (EU) 2023/2854, the Data Act).
2. After a Studio is deleted its data stays available for download for 30 days, under § 18(3a). After that time the Provider deletes it from the Service.
3. The Provider charges no fee for switching provider or for exporting data.
4. The formats in which data is handed over are described at projado.com/data-formats, and the jurisdiction that the Service's infrastructure is subject to at projado.com/jurisdiction.
§ 19. Particular risks
1. Using services provided by electronic means involves risks, including takeover of an Account, theft of sign-in details (phishing) and malicious software.
2. The Provider never asks for a password, or for an Account to be deleted, in an e-mail.
3. The User should use a strong password that they do not use in other services, keep their software up to date, and give Client Links only to the people they concern.
4. The Service stores on the User's device the cookies and browser-storage data needed for it to work, described in the Privacy Policy. The Extension keeps in the browser the data needed to stay signed in and to remember settings.
§ 20. Changes to these Terms
1. The Provider may change these Terms for important reasons, in particular a change in the law, a change in the scope or way the services are provided, the introduction of paid plans, or the need to keep the Service secure.
2. The Provider informs Users of changes by e-mail at least 30 days before they take effect, unless the change results from the law or the security of the Service and requires a shorter time.
3. Using the Service after the changes take effect requires accepting them, which the Service asks for at the next sign-in. A User who does not accept the changes may terminate the Agreement under § 18 and download a copy of their data first.
§ 20a. Change of Provider
1. The Provider may transfer the provision of the services within the Service to another entity. It informs Users by e-mail at least 30 days earlier, giving the name, address and identification number of the new entity and the day from which it will be the Provider.
2. During that period the User may terminate the Agreement at no cost and download a copy of their data and of the Studio's data.
3. Continuing to use the Service after the change requires accepting the new Provider's Terms and Processing Agreement, which the Service asks for at the next sign-in. A User who does not accept them can still download a copy of their data and delete the Account.
4. A change in the Provider's legal form as a result of which its rights and obligations pass to a successor by operation of law (for example a sole trader becoming a company) does not require the User's consent. The Provider informs Users of it by e-mail.
§ 21. Final provisions
1. Polish law applies to the Agreement.
2. Disputes with Users who are not consumers are settled by the court with jurisdiction over the Provider's address given in § 1(2). Disputes with consumers are settled by the court with jurisdiction under general rules.
3. These Terms take effect on 11 October 2026.
4. Annex 1: Data Processing Agreement.
